Article 1 (Purpose)
These Terms of Service ("Terms") govern the terms, conditions, and procedures for using the data packages for StarLink OceanBox terminals (the "Service") provided by ARION COMMUNICATIONS CO., LTD. (the "Company") through mall.arionit.com (the "Site"), and set out the rights, obligations, and responsibilities of the Company and users.
Article 2 (Definitions)
- OceanBox: A StarLink satellite-based data terminal installed on a vessel.
- Fleet Code: A 6-digit code identifying the specific vessel/fleet for which a data key is valid.
- ID/PIN Key: The digital activation key for OceanBox issued after payment is completed.
- User: A seafarer, vessel operator, or authorized agent who purchases the Service through the Site.
Article 3 (Effect and Amendment of Terms)
The Company may amend these Terms to the extent permitted by applicable law. When these Terms are amended, the Company will state the effective date and the reason for the amendment and post such notice on the Site 30 days in advance. If a user continues to use the Service after such notice, the user shall be deemed to have agreed to the amended Terms.
Article 4 (Eligibility)
Users must be of legal age capable of entering into a legally binding contract, and must hold legitimate authority over the Fleet Code being purchased against (as the vessel owner, operator, or an authorized designee thereof). Users are responsible for verifying the accuracy of the Fleet Code.
Article 5 (Description of the Service)
The Company sells 5GB and 10GB data packages with applicable validity periods. Upon completion of payment, an OceanBox ID/PIN key valid only for the selected Fleet Code is issued. Product composition, data volume, and pricing are as posted on the Site and may change with prior notice.
Article 6 (Order and Payment)
- The purchase procedure is as follows: select a data package → enter the Fleet Code → complete payment via the payment gateway → receive the ID/PIN key.
- Payments are denominated in US Dollars (USD) and are processed via credit cards and other electronic payment (“Pay”) methods supported by the payment system. Payment information is processed by a PCI-DSS compliant payment system, and the Company does not directly store card information.
- Users are responsible for entering the Fleet Code accurately. Issuance errors resulting from an incorrect Fleet Code will be resolved through the customer support verification process. Such processing is carried out on business days and may be delayed on public holidays and weekends.
Article 7 (Issuance and Delivery of Digital Keys)
The ID/PIN key is a digital product issued immediately upon completion of payment and is delivered via the key verification page, email, or SMS. Users must accurately provide contact information capable of receiving such delivery, and the Company shall not be liable for non-receipt resulting from incorrect contact information provided by the user.
Article 8 (Withdrawal and Refunds)
- As the ID/PIN key is digital content that becomes usable immediately upon issuance, the right of withdrawal and refund is limited once the key has been registered to an OceanBox device and its use has commenced.
- Where the key remains unused and there is a valid reason, such as an issuance error attributable to the Company, a refund may be requested through customer support within 14 days of the date of purchase.
Article 9 (Prohibited Conduct)
Users shall not engage in any of the following: unauthorized use of another person’s payment method; reselling or transferring ID/PIN keys without the Company’s prior written consent; reverse-engineering the Service; abusing the chargeback process through improper means; or otherwise violating applicable laws or these Terms. In the event of a violation, the Company may suspend provision of the Service and invalidate any keys issued to the user.
Article 10 (Disclaimer and Limitation of Liability)
- The Service presumes the normal operation of the StarLink satellite network and the OceanBox terminal. The Company shall not be liable for any interruption of the Service caused by satellite communication failures, weather conditions, terminal defects, areas where satellite communication service is unavailable, or other causes beyond the Company’s reasonable control.
- To the maximum extent permitted by applicable law, the Company’s total liability shall not exceed the amount paid by the user for the relevant product. The Company shall not be liable for any indirect damages, consequential damages, or loss of business.
Article 11 (Protection of Personal Information)
The Company collects and uses the minimum personal information necessary (contact details, payment-related information, etc.) for the purposes of order processing, payment, and customer support, and protects such information in accordance with its Privacy Policy. Further details are governed by a separate Privacy Policy.
Article 12 (Intellectual Property)
All intellectual property rights relating to the Site and the Service belong to the Company or its rightful owners, and users may not copy, distribute, or commercially exploit such rights without the Company’s prior consent.
Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, and any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the competent court of first instance in the Republic of Korea, as determined under the Civil Procedure Act. This shall not, however, affect any legal rights granted to consumers under the mandatory laws of the country in which the user resides.
Article 14 (Customer Support)
Inquiries relating to the Service, Fleet Code errors, refund requests, and similar matters are handled through the channel below.
- Email: acc@arionit.com
- Response Time: within 1 business day
Article 15 (Miscellaneous)
Even if any provision of these Terms is held to be invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby.
